I was a medical resident in 2006 and a medical fellow from 2007-2009. Do I qualify for the student FICA exemption during these years?

ANSWER

Expert Thomas Graham iii's Answer:

Unfortunately, I can’t give you a definite answer without more information about your particular situation. I can provide the guidelines that will allow an employee to be eligible for tax exempt status though. To be qualified for FICA tax exempt status a student must meet a combination of guidelines regarding their employment statues and also their enrollment status.
First, a student must be enrolled at least part-time with the university or college.
Second, a student must be employed in a “Student” job position that does not have retirement benefits and also is not a career path position.
Third, a student must not work more than 20 hours per week or more than 4.5 months a year.
All three of these guidelines must be met for a student to be qualified for FICA tax exempt status.
